Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “buyer,” or “user”) and Passports Collectibles (“we,” “us,” or “our”) governing your access to and use of passportscollectibles.com and any purchases you make through it.

BY ACCESSING, BROWSING, OR USING THE SITE IN ANY CAPACITY, OR BY COMPLETING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. If you do not agree to any portion of these Terms, you must immediately discontinue use of the Site.

You represent and warrant that you have the legal capacity to enter into binding contracts under the laws of your jurisdiction of residence.

Buyer Acknowledgment & Responsibility

You expressly acknowledge and agree that the purchase of collectibles, memorabilia, and autographed items involves inherent risk. You are solely responsible for conducting your own due diligence prior to any purchase, including:

Carefully reviewing all listing descriptions, photographs, condition notes, and authentication disclosures
Understanding the subjective nature of collectible grading, authentication, and valuation
Evaluating the appropriateness of each purchase based on your own independent judgment
Accepting all market risk, including the potential that the value of any collectible may change following purchase

By completing any purchase, you assume full and exclusive responsibility for your decision to purchase and waive any right to assert claims based on buyer's remorse, subsequent change of opinion, or shifts in market value.

Permitted Use of the Site

You agree to use the Site solely for lawful purposes. You expressly agree not to:

Engage in any activity that disrupts or interferes with the proper operation of the Site
Attempt to gain unauthorized access to any portion of the Site or its infrastructure
Use automated tools, bots, or scrapers to access or extract data without our written consent
Transmit viruses, malicious code, or any material intended to cause harm
Misrepresent your identity or provide false information
Use the Site for any fraudulent or unlawful activity
Reproduce or exploit any portion of the Site without written permission

We reserve the right to terminate or restrict your access to the Site at any time, for any reason, with or without notice.

Purchases & Payment

By placing an order you represent and warrant that: (i) you are legally permitted to make the purchase; (ii) you are the authorized holder of the payment method used; (iii) all information you submit is accurate and complete; and (iv) you have reviewed all listing descriptions and terms.

All payments are processed by Stripe, Inc. By submitting payment information you authorize us and Stripe to charge your payment method for the full amount including any applicable taxes and shipping. We do not store complete payment card details at any time.

An order is not accepted until payment has been successfully captured and a confirmation issued. We reserve the right to refuse or cancel any order at any time for any reason including suspected fraud, pricing errors, or stock unavailability. If payment has already been captured for a cancelled order, a full refund will be issued promptly.

All Sales Final — No Returns

All sales are final. Unless expressly stated otherwise in the individual item listing, or unless covered by our Authentication Guarantee, no returns, refunds, exchanges, cancellations, or adjustments of any kind will be permitted after the completion of a purchase. By placing an order, you expressly and knowingly waive any right to return an item for any reason including change of mind, dissatisfaction with condition, or unmet expectations.

We strongly encourage buyers to carefully review all listing details and contact us with any questions before completing a transaction. Once placed, an order is final and binding.

Pricing & Availability

All prices are in United States Dollars (USD) and subject to change without notice. The price at the time your order is confirmed is the price you will be charged.

In the event of a pricing error we reserve the absolute right to cancel the affected order and issue a full refund regardless of whether a confirmation was issued. We have no obligation to honor any transaction at an erroneous price.

All items are subject to availability. Listings may be withdrawn at any time and for any reason.

Item Descriptions, Condition & Grading

We make reasonable good-faith efforts to describe and photograph each item accurately. However we expressly make no warranty regarding the absolute accuracy of any description, photograph, condition report, or grading note.

The assessment of collectible condition and value is inherently subjective. Photographs may vary from the physical item due to monitor calibration and lighting conditions. You acknowledge that minor variations between listing descriptions and the physical item shall not constitute grounds for return, dispute, or chargeback.

Any condition grades or value estimates represent our good-faith opinion only and do not constitute a professional appraisal or certified grading assessment.

Authentication Guarantee

Every signed item is either accompanied by a Letter of Authenticity from PSA, JSA, or Beckett, or covered by our Authentication Guarantee.

Authentication Guarantee Terms: For any signed item sold without a pre-existing third-party LOA, if the original purchaser submits the item to PSA, JSA, or Beckett and it is formally rejected as inauthentic, we will issue a full refund of the original purchase price (excluding shipping and authentication fees) upon receipt of: (a) the original item returned in the same condition as sold; and (b) the official written rejection from the authentication service identifying the specific item. This guarantee is non-transferable, applies solely to the original purchaser, and claims must be submitted within 90 days of purchase. The guarantee does not cover items that have been altered, framed, or modified following purchase.

Shipping, Delivery & Risk of Loss

All orders ship via USPS, UPS, or a comparable carrier at our discretion. Estimated delivery times are guidance only and do not constitute a guarantee. We are not liable for shipping delays or failures caused by carriers or circumstances outside our control.

Risk of loss and title pass to the buyer upon delivery of the package to the carrier. Once tendered to the carrier we bear no responsibility for loss, damage, theft, or misdelivery. Claims for transit loss or damage must be filed by the buyer directly with the carrier.

You are solely responsible for providing an accurate shipping address. We are not responsible for packages lost or misdelivered due to buyer-provided address errors.

Disclaimer of Warranties

THE SITE AND ALL ITEMS AND SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS WITHOUT ANY WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind arising from your use of the Site or any purchase, including but not limited to lost profits, changes in collectible value, shipping delays, or description inaccuracies.

IN ALL CASES OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR ANY PURCHASE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ITEM GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless Passports Collectibles and its owners, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys fees) arising from: (i) your use of the Site; (ii) your breach of these Terms; (iii) your violation of any applicable law or third-party right; (iv) false information provided by you; or (v) any misuse of any item purchased from us.

This obligation survives termination of these Terms.

Chargebacks & Payment Disputes

You agree to contact us directly to resolve any purchase issue before initiating a chargeback or payment dispute with your bank or card issuer. Initiating a chargeback without first providing us a reasonable opportunity to resolve the issue constitutes a material breach of these Terms.

In the event of a chargeback filed in bad faith or in violation of our all-sales-final policy, we reserve the right to: (i) provide all transaction documentation to the payment processor in defense; (ii) pursue recovery of the disputed amount and associated fees; (iii) recover reasonable attorneys fees incurred; and (iv) permanently ban the buyer from future transactions.

Electronic Communications & Email Consent

Transactional communications. By completing a purchase or submitting the contact form, you consent to receive transactional emails including order confirmations and shipping notifications. These cannot be opted out of while an order is active.

Marketing communications. We send promotional emails exclusively to individuals who have opted in through our newsletter form. Placing an order does not constitute consent to marketing emails. You may unsubscribe at any time.

We comply with the CAN-SPAM Act of 2003 and do not send unsolicited commercial messages.

Intellectual Property

All content on the Site — including the Passports Collectibles name, wordmark, logo, photography, descriptions, and design — is our exclusive intellectual property protected by US and international copyright and trademark law.

No portion may be reproduced, copied, distributed, or exploited for any purpose without our express prior written consent. Unauthorized use may result in civil and criminal liability.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York without regard to conflict of law provisions. Any dispute shall be brought exclusively in the state or federal courts of New York. You consent to the exclusive jurisdiction and venue of such courts and waive any objection thereto.

Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right or provision shall not constitute a waiver thereof.

Modifications

We reserve the right to modify these Terms at any time in our sole discretion. Changes become effective immediately upon posting. Your continued use of the Site constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
